The UAE government took the initiative to implement different strategies in the country to maintain the Law and order situation. They also take up the initiative to safeguard the rights of the citizens along with the law and order. Public Prosecution was launched in Dubai in the year 1992 as per law no. 8. The ultimate goal was to have just judicial systems following the rights. In recent years a lot of simplifications have been introduced to it. There were a lot of barriers that were removed and negative implications were reduced. In Dubai, it is the sole authority to initiate criminal cases. It is undoubtedly an important part of the judicial system. It is also an integral part of the investigative process in the judicial system along with the imposition of charges, fines, and penalties. Dubai public prosecution takes up the work of supervising the legal case process that is going on in the criminal courts. They also take up the work of protecting the general public in the UAE. Any complaint lodged to the police is referred to the prosecutors within 48 hours. Following this, the police execute the orders from the public prosecution. An initial statement from the complainant, suspects, arrests, witnesses, and thus detailed investigations takes place. Following the arrest, the accuser is questioned within 24 hours. Afterwards, the decision to arrest or to release takes place under the law.
Prosecutor refers to a legal representative in common law and even in the civil law system. The public prosecution is categorized as a legal party that is held responsible to present the case. The representation is done in a criminal case which can be against an individual for breaking the law in any form. The public prosecutor has some responsibilities and roles concerning the work. They carry on with the investigations in the legal battle. Furthermore, they also impart the process of legal guidance to the investigating officer or staff. The basic purpose of public prosecution is to guarantee the right to justice and equality before the law. The public prosecutor acts with great objectivity and fairness. In addition, it is his prime responsibility to act as per the law.
Public prosecutors are also referred to as the magistrates. Just like the judges, the public prosecutors are magistrates who are supposed to be independent. Public prosecution service is termed as the institution whose motive is to guarantee the right to equality and fairness in the law. They take up the work of ensuring compliance with the laws and regulations. They adhere to the directions, instructions, and the orders by the statute. The public prosecution constitutes the hierarchy in it which is organized and has a proper structural system. One thing that is vital to note is that the authority in the hierarchy is exclusively internal. The public prosecutors report to their superiors in all the cases. They are reporting following the statutory guidelines given to them. Consequently, they have to follow the orders along with the orders they receive. The Public prosecutor enjoys the right to ask their superior subordinates to put up the orders in written form. Moreover, an order or an instruction must be in written form before it gets into effect in any case. The public prosecutors should refuse to adhere to illegal orders or instructions. This may be one under serious violation of their legal consciousness. The public prosecution service is not a public administration body. Moreover, it is not even categorized under the executive, political organ of power, or legislative. It does form part of the court.
